The online store www.les-petites-précieuses-jewelry.fr is operated by the company KOSHEEN SAS with a capital of 205 000 €, having its registered office at 102 Avenue des Champs Elysees, 75008 Paris, registered in the Paris Trade and Companies Register under number 488873944 (hereafter "LPP"). ARTICLE 1: SCOPE OF APPLICATION
The present general conditions of sale govern the sale of products presented on the website www.les-petites-précieuses-jewelry.fr (hereinafter the "Site"). Any order implies full acceptance of these terms and conditions of sale which are intended to define the rights and obligations of the parties in connection with the online sale of goods and services offered by LPP. The products offered by LPP are reserved for adults or minors holding parental permission to make an order on the Site.
ARTICLE 2: OFFERS
Our offers of products, services and delivery terms are indicated in Euros and are valid within the limits of available stocks.
ARTICLE 3 : PRICES
3.1 - All prices of our products are indicated in Euros and take into account the French VAT in force. Any change in the VAT rate could be immediately reflected in the prices. These prices do not include shipping costs.
3.2 - In the event of an order to a country other than metropolitan France, you are the importer of the products concerned. For all products shipped outside the European Union and DOM-TOM, the price will be calculated excluding taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and taxes are not under the control of LPP. They are your responsibility to declare and pay them to the appropriate authorities and organizations in your country. We recommend that you obtain information on these aspects from the local authorities in your country.
3.3 - LPP reserves the right to change its prices at any time but the products will be charged on the basis of the rates in effect at the time of registration of orders, as shown on the Site.
3.4 - The products remain the property of LPP until full payment is received by LPP.
3.5 - The products and services sold on the site are reserved for individuals.
ARTICLE 4: METHOD OF PAYMENT
The payment of online purchases is made by credit card via the secure payment platform PayPal. LPP reserves the right to suspend any order and any delivery in case of refusal of authorization of payment by credit card or in case of non-payment. LPP also reserves the right to refuse to honor an order from a customer who has not paid in full a previous order. Unless proven otherwise, the data recorded by LPP constitute proof of all transactions between LPP and the customer.
ARTICLE 5: DELIVER
LPP is committed to ensuring fast and reliable delivery of its products, both within mainland France and to the member countries of the European Union (excluding the United Kingdom). Several shipping options are available to meet the needs of each customer.
5.1. Delivery Areas
Products are currently delivered to mainland France and to countries within the European Union (24 countries). At this time, we do not offer delivery to the United Kingdom.

5.4. Order Processing Time
All orders are prepared and dispatched within 1 to 2 business days. Orders placed on weekends or public holidays are processed on the next business day.
5.5. Order Tracking
Once your order has been shipped, you will receive a confirmation email including a tracking link to monitor the status of your delivery in real time.
5.6. Returns and Refunds
Returns are accepted within 14 days of receiving your order, in accordance with our Returns and Refund Policy available on our website.

ARTICLE 6: RIGHT OF WITHDRAWAL
The customer has a period of seven days to exercise its right of withdrawal without having to justify reasons or pay penalties except for the cost of return, since the product is returned to LPP in its original condition and in its original packaging. In this case, LPP will refund the product upon receipt by LPP of the product, complete, in its original condition and original packaging. However, under the provisions of Article L. 121-20-2 of the Consumer Code, goods and objects made to customer specifications or customized at the request of the customer can not enjoy the right of withdrawal and will not be returned or exchanged, except in the case of implementation of the guarantee of defects affecting the object sold.
Withdrawal period
In accordance with the provisions of article L221-18 of the Consumer Code, the Customer has a period of fourteen (14) days from receipt of his order to exercise his right of withdrawal and make a request for return or exchange, without having to justify reasons or pay a penalty.
Condition of products
Returned items must be:

Unworn, unused;

In perfect condition;

In their original packaging, with all the labels and accessories provided upon delivery.
Any return not respecting these conditions may be refused by Maison Di Giorgio.
Return procedure
To exercise his right of withdrawal and make a return, the Customer must follow the following procedure:

Logging into the customer account
The Customer logs into their personal space via the access icon provided for this purpose, enters their email address, and enters the six-digit verification code received by email. -
Return Request
In the "My Account" area, the Customer selects the order in question, indicates the items to be returned, specifies the reason for the return and can add an additional note. The request is then subject to validation. -
Analysis and validation
After receipt and analysis of the request, Maison Di Giorgio informs the Customer by e-mail of the acceptance or refusal of the return. -
Return Shipping
If approved, the Customer will receive the necessary instructions and a prepaid return label. The package must be dropped off at a post office as soon as possible.
Exchanges
• Size Exchange
Size exchanges are free.
Once we receive your return, we will ship you the new size within 24 hours.
• Exchange for another item
You can exchange an item for another style or color by issuing a voucher for the original amount.
This voucher is valid for 6 months and can be used throughout the site.
Refund
You can request a refund for any reason within 14 days of receiving your order.
A flat-rate deduction of €10 will be automatically deducted from your refund, corresponding to logistics and processing costs.
After receiving your return, you will be refunded within 7 to 15 days, depending on your payment method.
In the event of a dispute, an amicable solution will be sought before any legal action is taken, it being recalled that this search for an amicable solution does not preclude the legal guarantees of conformity of the goods to the contract and hidden defects from which the customer benefits. In the absence of agreement between the parties, any legal action will be brought before the Commercial Court of Paris.
ARTICLE 9 : DURATION
The offers are valid while stocks last and without prior warning of the end of an offer.
ARTICLE 10: ACCEPTANCE AND CANCELLATION
Any order is deemed firm and can be canceled only with the express consent of LPP and under conditions that will compensate him for any loss or damage caused by this cancellation.
ARTICLE 11: INTELLECTUAL PROPERTY
All the jewels presented on the site or visual or sound elements of the Site are protected by copyright, designs or trademarks. They are the exclusive property of LPP. Any deterioration, as well as, in the absence of authorization, any representation, reproduction, modification, commercial use, total or partial, of the various elements of the Site is prohibited and exposes its author (s) to prosecution. Any user wishing to create an electronic link to the Site must request prior permission from LPP.
ARTICLE 12: RESPONSIBILITY FOR DATA
LPP makes every effort to ensure the confidentiality and security of data that may be entered or transmitted on the Site. LPP does not retain data relating to credit cards of our customers following payment. In accordance with the law "Informatique et Libertés" of January 6, 1978, you have a right to access and rectify data concerning you. You just have to send us by mail the opposition of access to your personal data by proving your identity.
ARTICLE 13: FORCE MAJEURE
Neither party shall have failed in its contractual obligations, insofar as their execution is delayed, hindered or prevented by an act of God or force majeure. Will be considered as fortuitous event or force majeure all facts or circumstances irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which could not be prevented by the latter, despite all efforts reasonably possible. The party affected by such circumstances shall notify the other within ten working days of the date on which it becomes aware of them. The two parties will then meet, within one month, unless impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued or, if necessary, the order cancelled.
ARTICLE 14: CONDITIONS OF GUARANTEE AND AFTER SALE SERVICE
Any manufacture, whatever the care, the attention given or the quality of the materials used involves, in spite of a rigorous control, risks of imperfection of manufacture which require an appropriate treatment. To this end, and to meet the needs of its customers, LPP has publishedthe following charter, which enables everyone to appreciate the extent and limits of the guarantees provided.
A) GUARANTEES:
LPP jewellery benefits from a double guarantee.
a) Guarantee against hidden defectsThis guarantee is
exercised under the conditions expressly defined
by the law and within the period of recourse set.In the hypothesis of a hidden defect which would affect a jewel of the Brand
LPP, the Company undertakes to replace the article within 4 weeks of the return by the private individual, provided, however, that it is a piece of jewellery still in the Brand's catalogue.Otherwise, a replacement item equivalent in value will be offered.
b) Contractual guarantees.
The LPP jewels are also guaranteed by the company under the conditions specified below, for a period of six months from the date of sale, transaction made on the site.
The guarantee covers possible modifications, alterations, degradations of the jewels inherent to the manufacture or to the nature of the employed material.
Are excluded from the guarantee:
- The degraded articles, damaged by an abusive use or by a use not in conformity with the nature, the coating, the material used by the manufacturer. Contact with detergents, sea or swimming pool water, lacquer, perfumes, acid products or any other liquids likely to alter the coatings, materials or simply to modify the appearance are prohibited.
- The Company reserves the right to assess, at its own discretion, whether the conditions of the contractual guarantee are met, upon receipt of the defective item.1) Exercise of the guarantee:
Prior to and before any shipment, the individual must:- provide proof of purchase, with date and reference.
(invoice or copy of the transaction made on the website .....) - send the article in a specially adapted envelope
to avoid any damage, to the Company's headquarters
.
2) modalities of intervention within the framework of the above guarantees:
- hidden defect :
The Company will proceed with the outright replacement of the defective item within fifteen days, subject to availability in stock.
Otherwise, a delay of three to four weeks will be necessary - contractual guarantee:
When the Company, upon receipt of the jewelry and proof of purchase, dated and referenced will have deemed that the warranty applies, it will proceed as follows:Repair of the item, if technically possible within 3/4 weeks
Replacement of the same item, subject to availability in stock, within 3/4 weeks.
The articles sent by the private individual are at the expense of the latter who also assumes the risk of loss or damage.
The reshipment of the jewels for which the Company will have accepted the implementation of one of the two guarantees above, will be ensured by the supplier and at its expenses.
B) AFTER SALE SERVICE
The Company ensures the after sale service under the restrictive conditions specified below.
This intervention is part of an ongoing and durable commercial relationship
between the client and the supplier intended, in the mutual interest, to facilitate the maintenance of commercial links.
Repairs are invoiced according to the extent of the damage
suffered by the jewel. A minimum fee of 25€ will be applied, including the postal costs of reshipment. The sending of the article for repair implies the acceptance, without any other formality, and the commitment to pay the above-mentioned fixed price. If the cost exceeds the fixed price, the Company will send an e-mail indicating
the amount to be paid and, after confirmation, the jewel will be repaired.
This will be done within 3/4 weeks.
When the jewel is technically or economically irreparable, it will be
scrapped or returned to the professional against payment of postal charges.
APPENDIX: APPLICABLE TEXTS
Article L. 211-4 of the Consumer Code
The seller is required to deliver goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He is also responsible for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.
Article L. 211-5 of the Consumer Code
To be in conformity with the contract, the goods must: 1° - Be suitable for the use usually expected of similar goods and, where appropriate : - correspond to the description given by the seller and have the qualities that the latter has presented to the buyer in the form of a sample or model; - have the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling; 2° - Or have the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, brought to the attention of the seller and that the latter has accepted.
